In addition, the Safety, Health and Welfare at Work (General Applications) Regulations 2007 came into effect on 1st November 2007 and contain further duties which may be relevant to those working in construction. ## The role of Project Supervisor New responsibilities and obligations have been placed on construction professionals, most notably with the introduction of the role of Project Supervisor Design Process and the expanded duties imposed upon designers. From our experience, consultants are seeking to embrace their statutory responsibilities and continue to be at the forefront in promoting a safety culture within the construction industry. The unfortunate reality is, however, that no consultancy firm, even with the best practices and safeguards in place, is ever completely immune from finding itself the subject of investigation. In conjunction with Arthur Cox Solicitors, we look, not at the specifics of the legislation, but at the practicalities of dealing with an investigation arising out of an accident or near-miss incident. ## Health and Safety Authority We examine the powers of the Health and Safety Authority ('HSA') and the rights of the consultant. To assist in understanding these items, we have included a section setting out some frequently asked questions. We also consider the extent of cover that should be provided by Professional Indemnity insurance and the measures that can be adopted post-accident to protect the consultant's position.
