Adjudication often causes problems for consultants.
Whether it is the fact that the adjudication rules are not ‘Construction Act’ compliant, arguments as to whether the adjudicator has the necessary jurisdiction, or questions as to whether the consultant has notified his Professional Indemnity (PI) insurers promptly enough, there is a lot that can and does go wrong.
This note stems from clients who are experiencing problems with the NEC suite of documents and the incorrect completion of the Contract Data section. Although seemingly innocuous, the problem can create real insurance issues for all who let it slip through the net.
