The Health and Safety (Offences) Act came into force on 16th January 2009.
Although the Act imposes no new duties, it does significantly broaden the scope for criminal penalties for breaches of existing health and safety legislation. The result is that there is now a real risk that Directors and employees could be imprisoned for breaches of health and safety legislation.
